Governor Spitzer Fallout: Workers' Comp Reforms in the Balance?

Earlier today The New York Times broke the story on its webpage that Governor Eliot Spitzer has been linked with a prostitution ring. Spitzer, known as a crusader against corruption, signed into law major workers' comp reforms in 2007.

If Spitzer resigns, Lieutenant Governor David A. Paterson will become Governor. Paterson is said to be a leading contender to fill Hillary Rodham Clinton's Senate seat if she becomes President.

It remains to be seen what will happen to the make up of Spitzer's Workers' Compensation Task Force, which has recently hired Dr. Christopher R. Brigham of Brigham & Associates as a consultant to evaluate the use of the AMA Guides on New York workers' comp claims.

Groups such as the New York Workers Compensation Alliance have decried the use of Brigham, which they claim is a secret attempt by the New York State Insurance Department to "hire one of the most anti-worker insurance company hack doctors in America to implement new disability guidelines in New York's Workers' Compensation system."

The NY Workers'' Comp Alliance reports that the NY State Insurance Dept has cancelled its study on the use of the AMA Guides. For now, we can safely assume that the AMA Guides are dead in NY. See http://www.nyworkerscompensationalliance.org for further information.
