Latest Updates, Including the Latest Official Forms Amendments, New Chapter on Appointment of an Ombudsman, New Small Business Case Chapter 11 Forms and New Small Business Debtor’s Sample Liquidating Plan.

Highlights of the latest updates include:

  • Latest Official Forms Amendments, including the revised Voluntary Petition and Means Test Forms (Official Forms 1, 22A, 22B, 22C), effective January 1, 2008.

  • New Part 30, “Appointment of Ombudsman,” includes forms and commentary related to the appointment of a consumer privacy ombudsman and a patient care ombudsman and the performance of ombudsman responsibilities under the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 (BAPCPA).

  • New Part 19, “Plans: Disclosure Statements” discussion and forms related to streamlined small business chapter 11 reorganization procedures under BAPCPA.

  • New Appendix Part 20, “Sample Plans and Disclosure Statements,” has been updated with a Small Business Debtor’s Liquidating Plan in compliance with BAPCPA.

  • New Part CS10, “Commencement of the Case,” has been updated with motion and order forms relating to the credit counseling and financial education requirements for consumer debtors under BAPCPA.

  • New Part CS14, “Discharge” consumer bankruptcy forms related to the Personal Financial Management Course Requirement for consumer debtors under BAPCPA.

  • Each update to the Forms Manual contains relevant forms and expert commentary contributed by Hon. Kevin J. Carey, United States Bankruptcy Court, District of Delaware; Bonnie Glantz Fatell, Blank Rome LLP; and Henry J. Sommer, Collier Editor-in-Chief.
