As a result of the decision of the United States Court of Appeals for the Ninth Circuit in United States v. Burlington N. & Santa Fe Ry. Co., 520 F.3d 918 (9th Cir. Cal. 2008), Petitioners, Burlington Northern & Santa Fe Railway Company, Union Pacific Transportation Company, and Shell Oil Company, sought review by the Supreme Court of the United States. The railroad petitioners filed a joint Petition for Writ of Certiorari and Appendix, and petitioner Shell Oil filed a separate Petition for Writ of Certiorari and Appendix.
