The Supreme Court of the United States issued its decision in Burlington Northern & Santa Fe Railway Co. v. United States,173 L. Ed. 2d 812 (U.S. 2009), on May 4, 2009, reversing and remanding the ruling of the United States Court of Appeals for the Ninth Circuit. Justice Stevens wrote the opinion of the Court, which was joined by Chief Justice Roberts and Justices Scalia, Kennedy, Souter, Thomas, Breyer, and Alito. Justice Ginsburg filed a dissenting opinion.
