Environmental Law - Product Update 5/22/2008 2:45:26 PM EST Brownfields Law and Practice: The Cleanup and Redevelopment of Contaminated Land: Latest Update, Including New Chapter on Common Law Liability Relief
Highlights of the May 2008 update include:
- New Chapter 5A, Common Law Liability Relief, which examines state statutory provisions that limit certain parties’ common law liability in connection with contaminated land.
- Discussion in Chapter 4, Liability of Parties to Brownfields Transactions Under CERCLA, about EPA’s new Prospective Lease Agreement, which is modeled after the agency’s bona fide prospective purchaser protection program; also a new subsection explaining EPA’s interim guidance regarding its “Good Samaritan” Initiative.
- Revisions to Chapter 16, State Property Transfer Acts, updating the states that have adopted the Uniform Environmental Covenants Act.
- New discussion in Chapter 18, Underground Storage Tanks and RCRA Corrective Action, explaining a final rule published by the U.S. Coast Guard concerning liability defenses for underground storage leaks near navigable waters.
- Coverage in Chapter 24, Institutional Controls, of a recent EPA memorandum entitled “Ensuring Effective and Reliable Institutional Controls at RCRA Facilities.”
- Updates in Chapter 27, Sources of Financing for Brownfields Redevelopment, on the Brownfields Revolving Loan Funds program.
- Discussion in Chapter 30, Tax Treatment of Environmental Remediation Costs, of an important recent Revenue Ruling by the IRS concerning the deductibility of a cost-cap policy as an “ordinary and necessary expense.”
- Discussion in Chapter 32, Particular Types of Brownfields Sites, of an amendment to the Toxic Substances Control Act that was passed as part of the Energy Independence and Security Act of 2007 creating a title for “healthy high performance schools” and requiring EPA to develop volunteer school site selection guidelines.
