Pfizer Inc. v. Apotex Inc. Case in Brief
Pfizer Inc. v. Apotex Inc. is interesting in that the Court found that, because a skilled artisan would have been motivated to combine the prior art to produce the compound at issue, that compound was obvious and the patent on which it was based was invalid. In addition, the mere fact that the patent holder had to verify the compound’s expected traits through testing did not show unpredictability and non-obviousness. The case was one of the first obviousness cases that the Court of Appeals for the Federal Circuit considered after the Supreme Court’s KSR ruling. Complete Case in Brief.
