New Volume 32 of Appleman on Insurance 2d to feature Chapters on Insurance for Acts of Terrorism, Hurricane Law
Coming in July 2008, new Volume 32 of Appleman on Insurance 2d will feature among other new chapters:
• Chapter 191, “Insurance for Acts of Terrorism”
• Chapter 192, “Hurricane Law”
Chapter 191 will discuss insurance case law arising from acts of terrorism, including those arising from the September 11 attacks. It will comprehensively analyze the Terrorism Risk Insurance Act of 2002 (TRIA), as amended by the Terrorism Risk Insurance Act of 2005 and the Terrorism Risk Insurance Program Reauthorization Act of 2007, as well as the administrative program created by the legislation. Examples will be provided and NAIC Policyholder Disclosure Notice forms will be provided. Policy considerations surrounding TRIA will also be discussed including insurance industry strategies, difficulties of assessing terrorism risks, the effect of TRIA subsidized insurance on the market, and the benefits and problems such subsidized insurance engender.
Chapter 192 will discuss insurance coverage law in the context of first-party property damage from hurricanes, including disputes over flood exclusions, anti-concurrent cause provisions, valued policy laws, insurance broker representations and more. The chapter will analyze coverage disputes and the interpretation of significant policy language, common law obligations and statutes.
