Medical Treatment—Utilization Review—Time to Issue Denial—WCAB upheld WCJ's finding that, for purposes of determining whether defendant timely served utilization review denial of treating physician's treatment recommendations pertaining to applicant/sales manager with 11/5/99 industrial injuries to back, neck, both upper extremities, both lower extremities, shoulders and psyche, treatment request mailed on a Thursday and received by defendant's mail processing facility on a Saturday was deemed to have been "received" by defendant within meaning of Labor Code § 4610(g)(1) on next business day, which was the following Tuesday as Monday was a holiday, so as to make utilization review denial served by defendant five days later timely.  © Copyright 2009 LexisNexis.
