In this Emerging Issues Analysis, Ronald Grais, Of Counsel to Jenner & Block, discusses “LEED Version 2009,” effective July 1, 2009. The article covers provisions important to property owners and occupants of LEED Certified Buildings, including the addition of new “Minimum Program Requirements” (MPRs). These MPRs include, for example, the requirement to comply with environmental laws; the requirement to use a reasonable site boundary; and the requirement for complying with minimum floor areas and occupancy rates. Also discussed are the types of projects subject to MPRs and the requirements applicable to both LEED Certified building owners and their tenants.
