Litigation has been filed in both federal and state courts in Louisiana concerning the discounting of payments by silent PPOs to healthcare providers for medical services that are provided to patients for treatment under the
Louisiana workers’ compensation act. This commentary, written by Denis Paul Juge, the author of Louisiana Workers' Compensation, examines the impact of the PPO statute, La. Rev. Stat. §§ 40:2201-2210, on workers’ compensation patients and their healthcare providers and analyzes the status of this litigation. He concludes that the courts will need to determine if the Louisiana workers’ compensation act permits a provider to contract with a payor to receive less than the fee that is established in the reimbursement schedule, and if the Louisiana legislature intended to include PPO contracts involving workers’ compensation claims when it created and amended the Any Willing Provider Act of La. Rev. Stat. Tit. 40.
