The Court of Justice found for the French cosmetics company L'Oreal against a company marketing imitation products of its unique fragrances in the UK. The Court essentially ruled that comparative advertising practices that infringe on a companies brand equity in the marketplace leading to a "...advantage unduly taken of the reputation of the mark" devalued the trademark of L'Oreal.
