Commercial Law - Product Update 5/22/2008 2:49:44 PM EST Asset Based Financing: A Transactional Guide Latest Update, Including Discussion of the UCP 600 Highlights of the latest update include:
- Full discussion of ''manufactured-home transactions'' (a distinct UCC Article 9 classification), which has been added to Chapter 8, “Conflicting Real Estate Interests.” It deals with the complex interplay among Article 9, the certificate of title laws, and fixtures.
- Coverage of UCP 600, which replaces the UCP 500. Chapter 12, “Letters of Credit,” also, analyzes transfer and assignment of letters of credit.
- A revised and updated Chapter 27, “Factoring.” Cross border sales transactions are increasingly important, and factors are called on to handle such sales. One approach is through membership in an international factoring organization, with the import and export factors working together much as banks do with respect to letters of credit. One such organization is the Factors Chain International. The current version of its "General Rules for International Factoring" (which is analogous to the UCP) is now included in Chapter 27. The chapter also discusses the UNIDROIT Convention on International Factoring.
