The Law of Hazardous Waste: September 2008 Update

Highlights of this update include:

Revised Chapter 1, “Introduction to Hazardous Waste Management,” features a new discussion of the Underground Storage Tank Compliance Act of 2005. This Act contains amendments to the original legislation that created the underground storage tank program, specifically revising many existing provisions of Subtitle I of Resource Conservation and Recovery Act (RCRA) and adding several new ones. Appendix 1-A, which reprints the statutory provisions of RCRA, has been updated to reflect the changes made by the Underground Storage Tank Compliance Act.

Revised § 7.01, “RCRA Requirements for Underground Storage Tanks,” reflects changes to RCRA’s requirements for underground storage tanks (USTs) made by the Underground Storage Tank Compliance Act of 2005. Among its many changes, the 2005 Act amended RCRA Subtitle I to better identify and correct noncompliant USTs on Indian tribal lands and at federal facilities. It also added provisions for updated and publicly accessible UST records, UST inspections and operator training, and provisions prohibiting deliveries to noncompliant USTs. There are also provisions mandating financial responsibility for UST manufacturers and installers and UST installer certification, and provisions for secondary containment of new and replacement tanks and piping near drinking water supplies, financial responsibility requirements for UST manufacturers, and cleanup of releases that contain oxygenated fuel additives.

Revised Chapter 18A, “SEC Disclosure Requirements for Hazardous Waste Liabilities and Expenditures,” discusses the latest developments pertaining to the disclosure of hazardous waste and Superfund liabilities as required under the SEC’s laws and regulations.
