Patent Law Digest
Posted by

Patent Law Digest, written by Donald S. Chisum, the top expert on patent law, has been completely revised to provide rapid access to every Federal Circuit patent decision, and contains concise summaries of all patent decisions of the U.S. Court of Appeals for the Federal Circuit. For this 2007 Edition, the cut-off date for Federal Circuit decisions is the end of December 2006 but the three 2007 Supreme Court decisions are also included due to their significance. First was a decision on jurisdiction in licensee-initiated suits for a declaratory judgment on a patent's validity and infringement--MedImmune, Inc. v. Genentech, Inc., 127 S. Ct. 764 (2007). Second was a decision on the export of software on a master disk as an infringement under 35 U.S.C. Section 271(f) (unauthorized exports of components of patented combinations)--Microsoft Corp. v. AT & T Corp., 127 S. Ct. 1746 (2007). Third was a decision on the “teaching, suggestion, motivation” test for the obviousness standard of patentability--KSR International Co. v. Teleflex Inc., 127 S. Ct. 1727 (2007).
