Hecker v. Deere & Co., 2009 U.S. App. LEXIS 2950
The judgment dismissing the employees' claims alleging violations of § 502(a)(2) of ERISA was affirmed because no breach of a fiduciary duty on the employer's part had been described; the Complaint did not allege that the representation in the Summary Plan Description supplement was an intentional misrepresentation.
