John R. Sand & Gravel Co. v. United States, 128 S. Ct. 750 (2008)
Appellate court properly determined sua sponte that claims against government in U.S. Court of Federal Claims were untimely under 28 U.S.C.S. § 2501, even though government waived timeliness, since longstanding and consistent precedent established that limitations period was jurisdictional and overturning that precedent was not warranted.
