Illinois Appellate Court: Vincent v. Department of Human Services, 2009 Ill. App. LEXIS 432
Trust beneficiary was required to spend down available assets before Medicaid would cover the medical expenses associated with her long-term nursing home care because the trust assets were available for her care under 42 U.S.C.S. § 1396a(k) (current version at 42 U.S.C.S. § 1396p(d)) as a precondition of her eligibility for medicaid assistance.
