A federal judge on Nov. 5 dismissed a personal injury action brought by a Mississippi woman who was hurt in a one-vehicle accident while a passenger in a car driven by an Oscar-winning actor, after an undisclosed settlement was reached (Demaris L. Meyer v. Morgan Freeman, No. 2:09-cv-38, N.D. Miss.).

Demaris L. Meyer sued Morgan Freeman on Feb. 25 in the U.S. District Court for the Northern District of Mississippi. Meyer and Freeman were involved in an auto accident on July 31, 2008, while they were driving to Freeman’s home in Charleston, Miss.

Freeman was driving Meyer’s 1997 Nissan Maxima at the time of the accident. He lost control of the vehicle, overcorrected his steering, and drove off of the highway and into a ditch. The Maxima flipped over several times.

Meyer was airlifted to a hospital, suffering from a broken left wrist and right scapula, a torn labrum in her right shoulder, pulmonary contusions, cervical strain, and numerous bruises and lacerations. She also claims to have suffered a closed head injury which resulted in cognitive difficulties and short term memory loss.

In her complaint, Meyer adds that she has suffered from mental anguish and emotional distress since the accident, and has not been able to return to work. She contended that Freeman’s negligence lead to her injuries.

Meyer sought damages for her medical expenses, pain and suffering, lost wages, permanent disability, mental and emotional distress, and property damage.  Judge Michael P. Mills dismissed the case with prejudice.
