The New Jersey Department of Health and Senior Services (NJDHSS) sent a letter to the U.S. Consumer Product Safety Commission (CPSC) alerting it to the risk posed by lead exposure from synthetic turf athletic fields, saying "there is sufficient reason for concern" and said that the potential for lead poisoning to occure is "plausible."
Two large questions linger.
What, if anything, is the CPSC prepared and equipped to do with this information? Legislation is pending in Congress which would increase the agency's budget and its staff.
Meantime, what class action/products liability litigation opportunities might emerge?
