Another live blog from the State Bar of Texas Advanced Workers' Compensation Seminar: Tim Stanford and Kay Goggin went after each other's positions regarding the proper analysis and application of the Texas Supreme Court''s Entergy decision, which held that a premise owner can also serve as a general contractor and, therefore, enjoy the exclusivity bar. Tim and Kay used a fact pattern to demonstrate the arguments counsel on both sides might employ. The Texas Supreme Court is reviewing its decision. The Legislature will likely overide the decision if the the Court takes no action.
