This just in. The Benefits Review Board has voted to publish E.M. v. Dyncorp International, BRB No. 08-0208, a case arising under the Defense Base Act.  The BRB decision reversed the ALJ's order (2006-LDA-147) that had found the claimant's claim was untimely among other things. The ALJ decision, which was reprinted in the Benefits Review Board Service Longshore Reporter at 41 BRBS 890(ALJ) is, therefore, no longer good law with respect to the finding on the timeliness of the claim.
