As the ubiquitous smartphones, tablets, and other mobile devices increasingly dominate the communications landscape, legislators and regulators are honing in on mobile data gathering methods and user privacy concerns. The trend signifies increased regulation of mobile app developers and companies that collect consumer data via mobile apps, as new statutes and regulatory proposals are rolled out at both the state and federal levels.

Failure to comply can be costly. In December 2012, California Attorney General Kamala Harris sued Delta Airlines under the state’s 8-year-old Online Privacy Protection Act, alleging that the airline is breaking state law by failing to warn users that Delta is collecting sensitive information each time customers use the “Fly Delta” mobile application. The penalty could be as much as $2,500 per download.

And more recently, on January 16, 2013, in a push to address mobile privacy protection, Georgia Congressman Hank Johnson released a draft of the Application Privacy, Protection, and Security Act of 2013 or APPS Act.
