Typical Tasks Performed by International Law Practitioners

There is no set list of tasks for an international practitioner as his/her activities depends on specialization, client, and the countr(ies) in which the client operates or desires to operate.   Examples of activities may include the following:
 
  • Determining if a country has double taxation agreements with the U.S. (Will the company be taxed both by the U.S. and the company in which it is operating? Will the country withhold tax from its employees based in the country?)
  • Ensuring compliance with various U.S. and international regulations (such as regulations relating to protecting and maintaining the privacy of information; environmental and safety issues; transport of illegal goods—e.g. wildlife—etc.);
  • Labor and employment issues (can I fire my German employee if he is on medical leave?);
  • Exporting goods—international sales agreements (CISG)
  • Determining the proper business form for operation within a particular country; setting up franchises, distributors
  • Avoiding antitrust fines and penalties (known generally as “competition law” outside the U.S.   E.g., Microsoft was heavily fined by the European Commission for its alleged Windows software monopoly, changing the company’s business practices.)
  • Monitoring decisions of the U.S. International Trade Commission and WTO
  • Locating a particular treaty, statute or regulation (e.g., extradition treaty)
  • Finding and employing local counsel
